What is “Ping On Zi”? How is it different from a will?
Ping On Zi” is the colloquial Cantonese term for a will. Both refer to the same legal document, which clearly sets out how your assets are to be distributed after your passing, who is appointed as executor and so on. In Hong Kong, a will must comply with the requirements of the Wills Ordinance to be valid.
What is “Estate Planning” (the Three Instruments of Peace )?
This refers to three key estate planning documents: a Will, an Enduring Power of Attorney (EPA), and an Advance Medical Directive (AD). Each serves a different purpose, and we recommend making early arrangements according to your personal needs to protect yourself and your family.
If no will has been made, how will the estate be dealt with?
If a person passes away without having made a will, their estate will be distributed in accordance with the statutory order set out under Hong Kong’s Intestates’ Estates Ordinance, which may not reflect the deceased’s wishes. The family will generally need to apply to the Probate Registry for letters of administration, and the appointed administrator will then deal with the estate.
Who is an “executor” and what are their duties?
The executor is appointed by the testator in the will to carry out their wishes. Duties include applying for a grant of probate at the Probate Registry, managing the estate, discharging debts, and distributing the estate to the beneficiaries in accordance with the will.
How long does the probate process take?
